This is old. The kids were being pretty disrespectful and didn't listen to any of the cop's instructions, so it serves them right.

Actually, the kids were in the right except the one that ran away. The officers also accosted the girl without reason. The officer also didn't read ANY of them their rights...that's against the law. You cannot formally arrest someone without reading them their rights; if you do, everything said and done at the crime scene is expunged from court hearings. As well, if the police officer is going to bring up the boy who "banged up his knee" for battery, then he should also fine himself for battery as he took the girl into a half nelson; an unprofessional move that is not allowed in my counties.

On another note, they can hardly be marked down for disorderly conduct. The only person who swore was the one who was protecting the girl; and that would stand up in court.

Police officers are also now days usually required to loosen handcuffs if requested. Why? Hemophiliacs and the like.

As for the arrest of the boys and girl; they all appear to be minors. At any time during their arrest they can claim their right to a lawyer, and if the officer had read them their rights, they would know that. "You have the right to an attorney, anything you say can and will be used against you in the court of law. If you cannot afford an attorney, you will be appointed one." That is the fifth amendment, in the middle. The right to remain silent. And that is the real hammer that says "You can't pin any of this on me." Because the kids weren't alerted of their fifth amendment, they weren't aware of the fact that they could stay silent and nothing could be accused of them. Because of this their attorney can claim "because of the illegitimacy of the peace officer and my clients being unaware of the situation at hand, they were not fully aware of the extent of their rights."

As a minor, you can claim the requirements of a lawyer and/or your parents at any moment and after that the officers cannot ask you any further questions; at least ones that can be used in the court of law.

By now, this officer probably no longer has a job. You can probably see him flipping burgers and salting fries. That's what happens when you let adrenaline get to your head.

Like Aaron said, this is old. And I think there's another topic about this somewhere.


The kids shouldn't of been skating there and the cop shouldn't of used force on a bunch of 13 year olds- neither one is in the right.
